Dear Sirs,

In connection with the application, as of 25 May 2018, the provisions of GDPR EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”) the Controllers shall be required to fulfill the disclosure obligation under Article 13 or 14 of the GDPR).

Therefore, Warter Fuels S.A. with its registered office in Warszawa kindly would like to inform you about the following:

  1. The controller of your personal data is Warter Fuels S.A. with its registered office in Warszawa at ul. Koralowa 60.
  2. Your personal data have been obtained and will be processed for the purposes related to the performance of the following: a) conclusion, performance and continuation of commercial contracts for the goods and services offered by the Controller, b) performance of the Controller's legal obligations (in particular: issuing and storing invoices, sales documents and other accounting documents, handling complaints), c) determining, defending and asserting claims, d) direct marketing, e) creating summaries of analyses and statistics (for the Controller's internal needs), f) verification of payment reliability, g) service support, h) broadly understood commercial cooperation, pursuant to Article 6(1)(a), (b), (c), (d), (e), (f) or Article 9(1) and (2)(a), (b), (c), (d), (h) and (j) of the General Data Protection Regulation of 27 April 2016, (i) handling of warranty and guarantee proceedings;
  3. The Personal Data Controller can be contacted at the address of the registered office of Warter Fuels S.A. ul. Koralowa 60, 02-967 Warszawa or at the address of the production facility, ul. Chemików 5, 09-411 Płock.
  4. The Data Protection Officer can be contacted in all matters relating to the processing of your personal data and the exercise of your rights in relation to data processing. E-mail address for contacting the Data Protection Officer: iod@warterfuels.pl.
  5. Legal basis for processing of your personal data by Warter Fuels S.A. Constitutes:
    1. fulfillment of the Controller's legal obligations to conclude and perform a commercial agreement (according to Article 6(1)(b) of the GDPR),
    2. fulfillment of the Controller's legal obligations to conclude and perform a service agreement (according to Article 6(1)(b) of the GDPR).
    3. performance of the Controller's legal obligations to the extent provided for by the specific provisions (according to Article 6(1)(c) GDPR),
    4. legitimate interest to serve, assert and defend its rights in case of dispute (according to Article 6(1)(f) GDPR),
    5. applicable laws and instructions prepared on their basis.

    Lawfulness of processing
    1. processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
    2. processing is necessary for compliance with a legal obligation to which the controller is subject;
    3. processing is necessary in order to protect the vital interests of the data subject or of another natural person;
    4. processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
  6. Your personal data may be disclosed by Warter Fuels S.A. to entities cooperating with it, in particular:
    - entities providing accounting and bookkeeping services,
    - entities providing legal services,
    - entities providing debt collection services,
    - dealing with tax advice,
    - entities providing occupational health and safety and fire protection services,
    - entities providing IT services,
    - Poczta Polska and other courier companies,
    - entities providing transport services, and state administration authorities.
  7. The provision of personal data, where it is a statutory requirement, is mandatory. In the case of the cooperation of a civil-law nature, the provision of personal data is voluntary, but failure to do so will mean that it will be impossible to commence and implement the cooperation. Provision of data in order to receive marketing content is voluntary, and not providing it means that you will not receive any information.
  8. Your personal data are processed through:
    1. period for the conclusion and exercise of rights and obligations relating to the performance of the contract concerned,
    2. period necessary to verify the payment reliability at the conclusion, renewal or extension of the contract or subsequent contract, including data obtained by the Controller from other sources
    3. period necessary for determining, defending and pursuing claims, defending rights in the course of judicial, administrative and other proceedings before public authorities, for the detection and prevention of fraud,
    4. period necessary for after-sales service,
    5. period, for which the provisions of the law require personal data to be stored (e.g. accounting or tax law),
    6. period, for which the Controller may suffer the legal consequences of a failure to comply with the obligation, such as a financial penalty.
  9. Personal data processed for the purposes of marketing the Controller's products and services, on the basis of a legitimate legal interest, will be processed until the data subject objects.
  10. Personal data processed on the basis of separate consent will be stored until revoked.
  11. The following rights related to the processing of your personal data appertain to you:
    1. right of access to your personal data (correcting, supplementing, e.g. when they are incorrect or incomplete),
    2. right to erasure (if the related rights allow it) or restriction of the processing of your personal data,
    3. right to transfer the data to another personal data controller (if it is technically possible to do so),
    4. right to object to the processing of the personal data by the controller on the basis of the Controller's legitimate interest or to the processing for the purpose of direct marketing,
    5. right to withdraw consent at any time (without affecting the lawfulness of the processing carried out on the basis of consent prior to its withdrawal),
    6. right to lodge a complaint with the supervisory authority, i.e. the President of the Office for Personal Data Protection.
